Appropriate Use Policy
Our Appropriate Use Policy (“AUP“) is designed to help protect our customers, and the Internet community, from irresponsible or illegal activities. Common sense and judgment are a necessary part of any system of rules, and this AUP is no exception. Of course, flagrant or repeated violations of the policy are viewed in a very different light than minor infractions. i29 considers net-abuse an action that undermines the ability of the Internet to serve as a discussion medium. In addition, net-abuse may be a violation of state or federal law, or the laws of other countries.

General Violations

Commercial use:
Use of the dial-up or wireless services for advertising, promotion or any other commercial uses is prohibited without the express written consent of i29.

Impersonation/Forgery:
Adding, removing, or modifying identifying network header information (aka "spoofing") in an effort to deceive or mislead is prohibited, including attempts to impersonate any person by using forged headers or other identifying information. Please note, the use of anonymous remailers and nicknames does not constitute impersonation.

Misuse of personal web space:
The personal web space provided with each dial-up and wireless account is not to be used for a site related to a business or money making venture. i29 sells Web Hosting services that are available specifically for businesses wishing to host their business pages online.

Network unfriendly activity:
Any activities which adversely affect the ability of other people or systems to use i29 services or the Internet are prohibited. This includes virus transition, "denial of service" (DoS) attacks against another network host or individual user.

Privacy violations:
Attempts, whether successful or unsuccessful, to gain access to any computer system or customer's data, without consent, are prohibited.

Threats:
Threats of bodily harm or destruction of property are always prohibited.

Internet Relay Chat (IRC) :
The use of IRC bots is prohibited, as is the violation of any accepted policies on IRC servers. If i29 is banned from a server, the offending account will be terminated.

Financial:
Sharing access with anyone other than immediate family members, or reselling service without express written consent from i29, or offering any public information service, such as running a web server or FTP server, is prohibited. Untimely payment of any and all amounts due may result in account cancellation.

Inactivity:
Using programs to defeat system timers limiting inactivity is prohibited. The services are intended for periodic, active use of e-mail, newsgroups, file transfers, Internet chat, games, and browsing of the World Wide Web. Members may stay connected so long as they are actively using that connection for the above purposes. Members may not use the services on a standby or inactive basis in order to maintain a connection. Pinging is expressly prohibited. Accordingly, i29 maintains the right to terminate any member's connection following any extended period of inactivity as determined by i29.

Excessive bandwidth or disk utilization:
If excessive bandwidth or disk space utilization is determined to adversely affect i29's ability to provide service, especially in cases of massive virus and spyware infections, immediate action will be taken. The account owner will be notified as soon as practicable and the account may be disabled temporarily. Users will not be credited for the time their accounts are disabled due to excessive bandwidth problems. Bandwidth utilization is determined by the total number of bytes transferred over Customer’s dialup or wireless connection, or from Customer's Web and FTP space. Disk utilization is determined by the total number of bytes required to store an account's Web, FTP, and Mail data.

Intellectual Property Rights:
You may use i29 for lawful purposes only. You may not submit or transmit through i29 or otherwise engage in any conduct that violates or infringes the rights of others including, without limitation, patent, trademark, trade secret, copyright, publicity or other proprietary rights.

E-mail

Commercial e-mail:
Sending unsolicited commercial e-mail is prohibited. Using an i29 e-mail or website address to collect responses from unsolicited commercial e-mail is prohibited.

Harassment:
Sending threatening or harassing e-mail is prohibited. If after being requested to stop, an i29 user persists in e-mailing another Internet user, i29 may intervene.

Viruses:
Transmitting any information containing viruses or destructive material via e-mail or any other means is prohibited.

Reporting Abuse

Targets of Abuse:
If you are aware of a potential inappropriate use, please direct the information to us at abuse@i29.net. We will attempt to investigate potential violations and take appropriate action.

Investigating abuse:
All complaints we receive will be actively investigated, and action will be taken when and where it is appropriate. Depending upon the severity of the abuse and the history of the account involved, we may take any one or more of the following actions; issue verbal or written warnings, suspend the account, or terminate the account.

Termination/Reactivation:
If an i29 account is used to violate the AUP, we reserve the right to terminate service without notice. Our preferred course of action would be to advise the account owner of the inappropriate behavior and corrective action necessary. However, flagrant violations of the AUP may result in immediate termination of service.

In the event that an account is temporarily inactivated as a result of any prohibited activities, the account may be subject to reactivation charges determined by i29.

Privacy

It may be necessary for i29 employees to examine system accounting logs and other records to resolve system problems. i29 reserves the right to access an account's mailbox to resolve system problems or mail system errors.

In addition, i29 will cooperate with the appropriate legal authorities in investigating claims of illegal activity, including but not limited to illegal transfer or use of copyrighted material, postings or e-mail containing threats of violence, or other illegal activity.

Security

Our customers are reminded that no computer system should be considered safe from intrusion. E-mail may pass through many computer systems, and should not be considered a secure means of communication unless encrypted. i29 makes no guarantee and assumes no liability for the security of any data on any server including "secure servers."
